Tuca Zbarcea & Asociatii wins for its client a set-aside of a final judgment on public procurement for breach of EU law primacy Tuca Zbarcea & Asociatii’s lawyers were granted by the Bucharest Court of Appeal a review of a final judgment on public procurement on grounds of breach of EU law primacy. This is a special legal remedy provided at Article 21(1) of Law No. 554/2004. The relevant procurement procedure involved a goods procurement contract in the healthcare sector. Commenting on the win, Gabriel Zbarcea, Managing Partner at Tuca Zbarcea & Asociatii, said: “I am pleased and honoured to accept this award on behalf of my team. It is already the third accolade awarded for our work on the Sanofi/Zentiva – Advent International deal in the past couple of weeks. I could not be happier, as such recognitions are testament to the complexity of the project and its market impact not only at a European, but also at a local level. After all, Romania is home to Zentiva’s only manufacturing facility outside the Czech Republic. I would like to thank and congratulate all parties involved in this cross-border M&A - our client, as well as the dozens of lawyers across Europe who ran the deal very professionally. Above all else, however, the award belongs to our team of lawyers whose tireless efforts successfully contributed to the completion of the transaction, including Silvana, Sorin, Oana, Mihaela, Dominic, Ciprian, Bogdan, Mihai, Dana, Daiana, Ana, Florentina, Ovidiu”. At any rate, this initiative is meant to refute the myth that Romanian students would only be interested in “traditional” law courses. We trust the new generations of legal practitioners. They are extremely talented and seem to be ever more pragmatic, creative and committed. We will seek the same set of values in the GDPR course. We promise pragmatism: we will blend theoretical concepts (which are necessary to assimilate the basics of GDPR) with genuine situations encountered in our practice. We will discuss noteworthy real-life cases and try to unravel GDPR’s threads together, in an interactive debate-oriented environment”, said Ciprian Timofte, Managing Associate at Tuca Zbarcea & Asociatii, data privacy law specialist and coordinator of this academic project. “Through its key departments (Academic Activities, Seminars & Conferences, Student Trainee Exchange Programme), ELSA Bucharest constantly contributes to the cultural and professional development of students and young legal practitioners. This year, the “Academic Activities” department launches a new challenge for the students: a large-scale project called ELSA Courses for the 2nd and 3rd year law students in Bucharest. By ELSA Courses – Keep Calm and Love GDPR we hope to attract many learners with a passion for this area, and – why not – who intend to specialise in GDPR in the future. Also, this initiative further strengthens our long-lasting cooperation with Tuca Zbarcea & Asociatii. In fact, we are honoured that this year Tuca Zbarcea & Asociatii law firm became an Official Partner of ELSA Bucharest”, added Ioana-Bianca Burciu, Vice President of Academic Activities at ELSA Bucharest.
