Limits of Market Behaviour Tuca Zbarcea & Asociatii has recently organized an interactive seminar focusing on competition law issues. In its first edition, the Limits of Market Behaviour has been organized on November 8th, in Bucharest and gathered over 70 representatives of the most important companies in Romania. In the context of the accession to the European Union, Romania experiences an important period of assimilation and implementation of the acquis communautaire in all the fields of activity. Competition rules are no exception, undergoing, in the past 10 years, several modifications and adjustments in order to align to the European rules. Moreover, the Competition Council has made important steps in view of fitting its policy within the principles and practice of the European Commission. Lawyers from our law firm, together with representatives of the Romanian Competition Council and economists specialized in competition matters have analyzed case law and hypothetical situations that have considerable chances of being encountered in the current activity of any market player and of being considered as practices not conforming to competition regulations. Beyond the legal provisions, the comprehension and interpretation of which is absolutely necessary, in practice, we have identified the necessity to clearly present the limits in which the market behaviour of undertakings would be considered in accordance with the competition rules. The topics focused on anti-competitive practices in general, cartels and the abuse of a dominant position with our lawyers presenting a number of interesting case studies covering a large range of specific industries, starting from various relevant case law of the decisional practice of the Competition Council and the European Commission.
