COVID-19 Legal Insights is our response to the COVID-19 outbreak. We shall keep you informed on the various legal challenges posed by the coronavirus, thanks to a dedicated practice group comprising lawyers with different backgrounds, such as compliance/regulatory, corporate and commercial, insurance, labour and employment, litigation and arbitration, insolvency, public procurement, data privacy, tax and customs. In addition, our taskforce offers strategic advice on crisis-specific matters: corporate restructuring, review and (re)negotiation of agreements (including collective bargaining agreements and individual employment contracts), performance of the contracts which are affected by force majeure and hardship, unblocking pre-litigation relationships, etc.

New tax measures in the context of current economic difficulties caused by COVID-19 (29 June)
 

In the context of the economic and financial difficulties caused by the pandemic of the new COVID-19 virus, the Romanian Government adopted the Emergency Ordinance No. 99/2020 regarding certain fiscal - budgetary measures, amendment of certain acts and extension of certain deadlines ("EOG No. 99/2020"), published in the Official Gazette No. 551/25.06.2020.

Relevant highlights:

  • Specific tax;
  • VAT measures;
  • Measures concerning the bonuses granted for the payment of micro-enterprise tax/profit tax;
  • Extension of the applicability of certain fiscal measures.

In the context of the economic and financial difficulties caused by the spread of the COVID-19 virus, the Government of Romania adopted the Emergency Ordinance No. 69/2020 for amending and supplementing Law No. 227/2015 regarding the Fiscal Code as well as for implementing certain fiscal measures ("GEO 69/2020"), published in the Official Gazette No. 393/14.04.2020. Also, the Government Emergency Ordinance No. 33/2020 on certain fiscal measures and the amendment of certain normative acts was implemented through Law No. 54/2020 ("Law 54/2020"), published in the Official Gazette No. 396/15.05.2020. Relevant highlights: Extension of the deadline for submitting the Single Tax Return for 2019 income and grant of related bonuses; Cancellation of ancillary obligations; Tax facilities for granting incentives/bonuses to employees; Granting certain facilities with respect to the building tax; Granting facilities for the payment of the rent and the tax due for the occupation of the public domain; Bonuses granted to corporate income tax payers and microenterprise tax payers correspondent to second and third quarters of 2020. Tax measures in the context of the economic difficulties caused by COVID-19 (18 May)
 

In the context of the economic and financial difficulties caused by the spread of the COVID-19 virus, the Government of Romania adopted the Emergency Ordinance No. 69/2020 for amending and supplementing Law No. 227/2015 regarding the Fiscal Code as well as for implementing certain fiscal measures ("GEO 69/2020"), published in the Official Gazette No. 393/14.04.2020.

Also, the Government Emergency Ordinance No. 33/2020 on certain fiscal measures and the amendment of certain normative acts was implemented through Law No. 54/2020 ("Law 54/2020"), published in the Official Gazette No. 396/15.05.2020.

Relevant highlights:

  • Extension of the deadline for submitting the Single Tax Return for 2019 income and grant of related bonuses;
  • Cancellation of ancillary obligations;
  • Tax facilities for granting incentives/bonuses to employees;
  • Granting certain facilities with respect to the building tax;
  • Granting facilities for the payment of the rent and the tax due for the occupation of the public domain;
  • Bonuses granted to corporate income tax payers and microenterprise tax payers correspondent to second and third quarters of 2020.

In the context of the economic and financial difficulties caused by the COVID-19 epidemic, in the Official Gazette No. 319/16.04.2020 was published the Government Emergency Ordinance No. 48/2020 regarding new fiscal - budgetary measures ("EOG 48/2020"). Also, in the Official Gazette No. 325/21.04.2020 was published the Order No. 935/2020 on amending and supplementing Order of the President of the National Agency for Tax Administration No. 587/2016 for the approval of the model and content of the forms used for the declaration of self-imposed or withholding tax ("Order 935/2020"). Fiscal measures in the context of the economic difficulties caused by the COVID-19 (23 April)
 

In the context of the economic and financial difficulties caused by the COVID-19 epidemic, in the Official Gazette No. 319/16.04.2020 was published the Government Emergency Ordinance No. 48/2020 regarding new fiscal - budgetary measures ("EOG 48/2020"). Also, in the Official Gazette No. 325/21.04.2020 was published the Order No. 935/2020 on amending and supplementing Order of the President of the National Agency for Tax Administration No. 587/2016 for the approval of the model and content of the forms used for the declaration of self-imposed or withholding tax ("Order 935/2020").

Relevant highlights:

  • Deduction of sponsorship amounts by micro-enterprise taxpayers
  • The exemption of certain benefits in kind from the payment of income tax and social security contributions
  • Additional provisions regarding the taxation of the technical unemployment indemnities, as well as the indemnities for days off granted to parents performing activities in certain domains of activity

In the context of the economic and financial difficulties caused by the spread of the COVID-19 virus, the Romanian Government has adopted the Emergency Ordinance No. 33/2020 regarding certain fiscal measures and the amendment of certain normative acts, published in the Official Gazette No. 260/30.03.2020.

Relevant highlights:

  • Taxpayers paying on time the corporate income tax due on 25 April 2020 will receive a bonus of 5% or 10%;
  • VAT is no longer payable for imports of goods used for the prevention and treatment of COVID-19.

New fiscal and budgetary measures in the context of the economic difficulties caused by the COVID-19 epidemic (21 March)
 

In the context of the economic and financial difficulties caused by the COVID-19 epidemic, the Romanian Government adopts the Emergency Ordinance No. 29/2020 regarding new fiscal-budgetary measures, published in the Official Gazette No. 230/21.03.2020.

As such, amendments to the Fiscal Code, the Fiscal Procedure Code and the Government Ordinance No. 6/2019 were introduced, such as:

  • Extension of the deadline for payment of local taxes;
  • Facilities for taxpayers applying the advance payments system for CIT purposes;
  • Alleviation of punitive measures;
  • Extension of the period during which the facility for restructuring the tax obligations can be requested.
