Țuca Zbârcea & Asociații saves the Bucharest Municipal Football Association from dissolution

Țuca Zbârcea & Asociații has secured the admission of a revision against the final judgment ordering the dissolution of the Bucharest Municipal Football Association, as well as the definitive rejection of the applications for dissolution of the association. The judgement safeguards the existence of the Bucharest Municipal Football Association, the competitions it organizes in Bucharest – including those for children and juniors – and all its assets.
The Bucharest Municipal Football Association had been judicially dissolved by the Bucharest Tribunal in September 2024, by a final judgment that held the association was allegedly subject to the grounds for dissolution due to the illicit nature of its activities (Article 56(1)(a) of Government Ordinance No. 26/2000). The dissolution decision rendered by the appellate court imputed to the Association alleged irregularities in its organizational structure, which would have justified the sanction of dissolution.
The impact of the dissolution would have been significant, calling into question the continuation of the sporting competitions organized by the Association in Bucharest, including those at youth level, the ongoing projects dedicated to football in Bucharest up to and including League IV, and jeopardizing the Association’s assets, which would have been transferred to the Romanian State.
Taking over the case only after the final dissolution ruling had been rendered, the lawyers of Țuca Zbârcea & Asociații invoked grounds warranting the pursuit of the extraordinary legal remedy of revision. In the revision proceedings, the Bucharest Tribunal first ordered the suspension of the effects of the dissolution decision and subsequently admitted the revision, thereby annulling the dissolution decision and definitively rejecting all claims brought by the entities that had requested the imposition of this sanction.
